Please read these terms and conditions carefully. By accessing this site and any pages thereof, our products and services, you agree to be bound by the terms and conditions below. Payment Terms

Newbery Consulting has a strict 14 day payment terms. If we have issued you with an invoice, the payment is due 14 days after that invoice was issued. If you are having difficulty meeting this payment timeline, you must contact us immediately and request a a payment extension. An extension will usually be given for an additional 14 days. If any invoice is not paid in full from 29 days after the invoice was issued, Newbery Consulting will be entitled to charge you 5% interest on the amount owing for each day the amount remains unpaid. This interest is compounding so the 5% charged on any day will be based on the compounding amount calculated on the original outstanding amount plus an additional 5% for every day the amount remains unpaid. By “unpaid” we mean the date that payments are received into our account.

We are dead serious about this. Nothing pisses us off more than when a client does not have the decency to pay our invoices on-time. We do our best to provide a great service and we expect to be paid for those services on-time.


Use of Information and Materials

The information and materials contained in these pages (the website), and the terms, conditions, and descriptions that appear, are subject to change. Unauthorised use of Newbery Consulting web sites and systems including but not limited to unauthorised entry into Newbery Consulting systems, misuse of passwords, or misuse of any information posted on a site is strictly prohibited.


Use of Information and Materials – Webinars

Persons who register for and attend webinar sessions with Newbery Consulting representatives will view information and receive electronic materials that are owned by Newbery Consulting. These materials are subject to copyright protection and have been supplied for the purpose of individual professional development delivered as a paid webinar. Under no circumstances may this material be copied or reproduced without the permission of Newbery Consulting.

Under no circumstances are recordings of webinars; which are supplied to registrants, to be distributed or made available for public viewing. These have been supplied on the basis of individual professional development only for individuals who have paid for a webinar registration fee. If clients would like to arrange such public viewing, they should contact Newbery Consulting to discuss this possibility under a fee arrangement.



This site may contain links to web sites controlled or offered by third parties (non-affiliates of Newbery Consulting). Newbery Consulting hereby disclaims liability for, any information, materials, products or services posted or offered at any of the third party sites linked to this website. Creating a link to a third party website.

Newbery Consulting does not endorse or recommend any products or services offered or information contained at that website, nor is Newbery Consulting liable for any failure of products or services offered or advertised at any of the third party sites. Such third parties may have a privacy policy different from that of Newbery Consulting and the third party website may provide less security than the Newbery Consulting site.

Limitation of Liability

In no event will Newbery Consulting be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with this site or any linked site or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Newbery Consulting, or representatives thereof, are advised of the possibility of such damages, losses or expenses.



All information submitted to Newbery Consulting via this site shall be deemed and remain the property of Newbery Consulting and Newbery Consulting shall be free to use, for any purpose, any idea, concepts, know-how or techniques contained in information a visitor to this site provides Newbery Consulting through this site. Newbery Consulting shall not be subject to any obligations of confidentiality regarding submitted information except as agreed by the Newbery Consulting entity having the direct customer relationship or as otherwise specifically agreed or required by law. Nothing contained herein shall be construed as limiting or reducing Newbery Consulting’s responsibilities and obligations to customers in accordance with the Newbery Consulting Privacy Policy or Australian Privacy laws.


Refunds and Exchanges

Newbery Consulting complies with the requirements of the Consumer Guarantees under the Australian Consumer Law (click here). Consumer guarantees do not apply if the consumer:

  • is a business entity such as a:
    • Sole trader
    • Company
    • Partnership
    • Trust
  • got what they asked for but simply changed their mind, found it cheaper somewhere else, decided they did not like the purchase or had no use for it
  • misused a product in any way that caused the problem
  • knew of or were made aware of the faults before you bought the product
  • asked for a service to be done in a certain way against the advice of the business or were unclear about what you wanted


Refund Policy – Webinars

Persons who have registered and paid for attendance at a webinar are entitled to a refund where they give notice of their request to withdraw from viewing webinar and the webinar the person purchased has not already been viewed. Note, that Newbery Consulting customer relationship software monitors if and when a webinar is viewed by the registrant. Notice of requests to withdraw from an event must be made in writing.  All requests can be made via email to enquiries@newberyconsulting.com.au.


Refund Policy – Nationally Recognised Training offered by Newbery Consulting as an RTO

Learners, who give notice to cancel their enrolment 10 business days or more prior to the commencement of a program, will be entitled to a full refund of fees paid. Learners who give notice to cancel their enrolment 9 business days or less prior to the commencement of a program will be entitled to a 75% refund of fees paid. The amount retained (25%) by Newbery Consulting is required to cover the costs of resources which will have already been committed based on the learners initial intention to undertake the training. Learners who cancel their enrolment after a training program has commenced will not be entitled to a refund of fees which have been paid. If Newbery Consulting cancels or ceases to provide training, Newbery Consulting must issue a full refund for any services not yet provided. The basis for determining “services not yet provided” is to be based on the units of competency completed by the learner and which can be issued in a statement of attainment at the time the service is ceased.


Cancellation of a transaction – Products

Where a consumer has paid for a product and that product has not yet been supplied, the consumer is entitled to cancel their transaction and receive a full refund of the product payment made to Newbery Consulting. Requests to cancel a transaction must be made within one hour from submitting a product purchase to Newbery Consulting. Requests to cancel a transaction can be made via email to enquiries@newberyconsulting.com.au or by contacting Newbery Consulting on 02  8005 8029.


Delivery Timeframe for Products and Services

All services will be delivered in a timeframe which is specified on each service page description on this website. All products will be supplied via email within 24 hours of receiving the payment for products into the bank account of Newbery Consulting.


Limits of Warranty and Liability relating to our RTO Registration Service

To the extent permitted by law, Newbery Consulting provide no warranty and make no claim in relation to our performance, the performance of our consultants or provide any guarantee for the outcome of services we provide. By accessing Newbery Consulting services, you waive and release Newbery Consulting to the full extent permitted by law from any and all claims relating to the usage of our consulting services. In no circumstances, shall Newbery Consulting be liable for any incident, consequential damages or loss  resulting from the use of our consulting services.


Availability & Additional Terms

This site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation. Sections or pages on this site may contain separate terms and conditions, which are in addition to these terms and conditions. In the event of a conflict, the additional terms and conditions will govern for those sections or pages.


Changes to Terms and Conditions

Newbery Consulting reserves the right to amend these terms and conditions at any time.  If amendments are made to terms and conditions that effect a person or organisation utilising Newbery Consulting’s products and services, a written notice will be provide no less that 28 working days prior to any changes taking effect. Students undertaking Nationally Recognised Training offered by Newbery Consulting as an RTO, have 28 days to submit an appeal from the date they were informed of any decision or changes to terms and conditions .
